Five Phases. Zero Surprises.
We handle QDROs for virtually every type of retirement plan. Here's the playbook.
Free Consultation
We start with a no-obligation phone call. Willie learns about your divorce decree, the retirement plans involved, and what your settlement agreement says about the division. Most consultations take 15–20 minutes.
💡 Bring your divorce decree or settlement agreement if you have it — but we can work without it.
Document Gathering
Once engaged, we collect the documents we need: your final divorce decree or QDRO-specific court order, the plan summary from your spouse's employer, and any other relevant financial disclosures.
💡 Willie's team handles most of the heavy lifting — we often contact plan administrators directly to get plan-specific requirements.
QDRO Drafting
Willie drafts your Qualified Domestic Relations Order to each plan's exact specifications. Every plan is different — 401(k), pension, 403(b), CSRS, CalPERS — and each has its own accepted language and formatting requirements.
💡 Turnaround is typically 5–10 business days per plan once documents are received.
Plan Administrator Review
We submit the draft QDRO to the plan administrator for pre-approval before it goes to the court. This is a critical step most attorneys skip — it prevents rejections after court entry and reduces the risk of avoidable rejection.
💡 Pre-approval review can take 2–8 weeks depending on the plan. We follow up proactively.
Court Entry & Filing
Once the plan administrator approves the draft, we prepare the final QDRO for court entry. After the judge signs, we send certified copies to the plan administrator. Your division is now legally effective.
💡 We provide you with a fully executed copy for your records. After this, the plan handles the actual distribution or account split.
Why Pre-Approval Is Non-Negotiable
Many attorneys skip the plan administrator pre-approval step. This leads to court-entered QDROs getting rejected months or years later — requiring expensive amendments and more court appearances. Willie always gets pre-approval first. It costs more time upfront, but it prevents disasters.
Common Questions About the Process
How long does the whole process take?
From engagement to final court entry, most QDROs take 6–16 weeks. The biggest variable is plan administrator pre-approval time — some plans respond in 2 weeks, others take 8. We communicate every step of the way so you're never in the dark.
What if there are multiple retirement plans to divide?
Each retirement plan requires its own QDRO. We handle multi-plan divorces regularly — you'll get a flat fee per plan, no per-hour surprises. Many clients have 2–4 plans in a single divorce.
Do I need to be in Connecticut to work with Peacock Law Firm?
